Terms & Conditions
These Terms govern use of the WebTownship website and general enquiries. Paid services, projects and ongoing engagements are governed by the proposal, quotation, Project Agreement, Statement of Work or other written terms accepted for that engagement.
1. Scope
These Terms apply to use of WebTownship's public website, contact forms, published information and general pre-contract communications. They do not replace a signed Project Agreement, Statement of Work, Master Services Agreement, proposal, quotation, purchase order or other written agreement accepted by WebTownship and the client.
If project-specific written terms conflict with these general website Terms, the project-specific written terms apply to that engagement to the extent permitted by applicable law.
2. Website use
You may use this website for lawful business, informational and enquiry purposes. You must not attempt to disrupt the website, gain unauthorized access to systems or accounts, submit malicious code, misuse forms, scrape protected information, impersonate another person, or use the website in a way that violates applicable law or third-party rights.
Website content is provided for general information and may be updated as services, technology, business details or policies change.
3. Enquiries, estimates & proposals
Submitting a form, requesting an estimate, attending a discovery call or receiving a proposal does not by itself create a binding project engagement. Scope, deliverables, responsibilities, schedule, dependencies, fees and payment terms are confirmed in the applicable written commercial document.
Unless a proposal expressly states otherwise, estimates are based on the information available at the time and may change if requirements, assumptions, integrations, third-party constraints or timelines change.
4. Project agreements & scope
Each project may use a proposal, quotation, Project Agreement, Statement of Work or similar document to define the work. Material changes to agreed scope, deliverables, integrations, responsibilities, acceptance criteria, schedule or commercial terms may require a written change order or revised agreement.
Delivery dates may depend on timely client feedback, approvals, content, credentials, third-party access, payment and other dependencies identified for the project.
5. Fees, invoices & payments
Fees, taxes, deposits, milestones, retainers, billing intervals and payment due dates are defined in the applicable quotation, invoice or project agreement. Unless otherwise agreed in writing, third-party charges such as hosting, domains, cloud services, licenses, plugins, stock assets, paid APIs, advertising spend or platform fees are separate from WebTownship service fees.
WebTownship may pause work or withhold delivery where an undisputed payment is materially overdue, subject to the applicable project terms and law.
6. Client responsibilities
Clients are responsible for providing accurate requirements, timely feedback, necessary approvals, lawful content, appropriate access credentials and any third-party permissions required for the work. The client remains responsible for reviewing and approving business, legal, regulatory and factual content before publication.
Where WebTownship works in an existing system, the client should maintain appropriate ownership or authorization for that system, account, codebase, domain, data or third-party service.
7. Intellectual property
Ownership and licensing of project deliverables are governed by the applicable project agreement and payment status. Pre-existing WebTownship tools, reusable components, know-how, frameworks, libraries and third-party materials remain subject to their existing ownership or license terms.
Third-party software, fonts, images, plugins, APIs, platforms and open-source components remain subject to the rights and licenses of their respective owners.
8. Third-party platforms & services
Projects may depend on third-party platforms such as hosting providers, payment gateways, app stores, cloud services, advertising networks, analytics products, APIs or software vendors. WebTownship does not control those providers' availability, pricing, approval decisions, policy changes or service interruptions.
Where appropriate, WebTownship will help configure or integrate such services, but the client remains subject to the third party's own terms and policies.
9. Confidentiality & credentials
Confidentiality obligations may be set out in an NDA or project agreement. WebTownship will use reasonable care when handling confidential project information and access credentials supplied for delivery. Clients should avoid sending unnecessary secrets through public contact forms and should use agreed secure channels for sensitive credentials.
10. Quality, acceptance & warranties
WebTownship aims to deliver work that materially matches the agreed scope and acceptance criteria. Testing, acceptance periods, defect correction, warranty periods, maintenance and support commitments vary by engagement and should be stated in the applicable project terms.
Unless expressly agreed in writing, WebTownship does not guarantee specific search rankings, advertising outcomes, revenue, conversion rates, traffic levels, app-store approval, uninterrupted third-party services or other results substantially controlled by external factors.
11. Liability & non-excludable rights
Nothing in these Terms is intended to exclude rights or remedies that cannot lawfully be excluded. Any project-specific limitation of liability, indemnity, warranty or dispute provision is governed by the applicable signed agreement.
To the extent permitted by applicable law and where no project-specific written term applies, WebTownship is not responsible for indirect or consequential loss arising solely from use of informational website content, third-party websites or third-party service interruptions.
12. Cancellation, suspension & refunds
Project cancellation, termination, credits and refunds are governed first by the applicable signed project terms and then by WebTownship's general Project Cancellation & Refund Policy.
There is no automatic one-size-fits-all refund formula for every project. Completed work, earned fees, unused prepaid amounts and unavoidable third-party commitments are reconciled against the applicable engagement terms.
13. Changes to these Terms
WebTownship may update these website Terms when services, processes, technology or legal requirements change. The effective date shown on this page identifies the current public version. Updated website Terms do not automatically replace project-specific contractual terms already agreed for an active engagement unless the parties agree otherwise in writing or applicable law requires it.
